-To pick-up (when bonuses are withdrawn - 22% discount on pick-up is not valid);

Agreement of Pizza House application usage

1. GENERAL STATEMENTS

1.1 Pizza House application is a loyalty program for the Pizza House guests.

1.2 This Agreement (hereinafter - Agreement) on the use of Pizza House mobile application (hereinafter - Application) regulates the relations between the developer of the Application - Pizza House (hereinafter - Developer) and the Individual, who has joined the use of the mobile application (hereinafter - User).

1.3 Any individuals and legal entities are considered Users of the Application.

1.4 The terms of this Agreement shall be an Adhesion Contract in accordance with Article 634 of the Civil Code of Ukraine. 

1.5 The Application is a program developed for mobile devices running iOS and Android operating systems, including tablet devices (hereinafter referred to as mobile devices).

1.6 The action of the Application is aimed at increasing the number of sales and supporting the awareness of Users.  

1.7 The Company grants the User the right to use the Application on a free-of-charge basis.

1.8 By accepting the terms of this Agreement, the User confirms that he has read, agrees and fully accepts the terms of this Agreement and gives his consent to the processing of his personal data entered in the Application by the Developer.

1.9 Appeals, suggestions and complaints of the User to the Developer relating to the functioning of the Application can be sent to the e-mail: oper.marketolog.pizzahouse.com.ua 

2. MECHANISM OF OPERATION OF THE APPLICATION

2.1 Through the Application it is possible to make orders in the pizzeria, for delivery and pick-up.

2.2 The application can be downloaded through the service Play Market and App Store.

2.3 There is a system of bonuses as part of the application, the gradation of bonuses see 6.8.

2.4 The use of bonuses means payment of the cost of the products with the amount of collected 5% bonuses.

2.5 Program bonuses cannot be transferred, sold, or expropriated in any way.

2.6 When registering personal data in the Appendix, the User receives a gift, which is pizza Рepperoni 30 sm

3. USER'S RIGHTS AND OBLIGATIONS

3.1 The User undertakes to properly comply with the terms of this Agreement.

3.2 The User has the right to use the Application exclusively for personal use in accordance with the terms of this Agreement.

3.3 The User agrees not to use the Application in order to violate the rights and legitimate interests of the Developer.

3.4 The User gives his consent to the Company to process his personal data in accordance with the law of protection of personal data.  

3.5 Before installing the Application, the User must read all information about the Application. Installing the Application confirms that the User has complied with this paragraph and agrees with all the terms of the Agreement.

3.6 The User has the opportunity to download the Application for free and use its full functionalities.

3.7 If the User does not agree with the terms of the Agreement, the User is required to stop using the Application.

4. DEVELOPER'S RIGHTS AND OBLIGATIONS

4.1 This Agreement may be modified and/or amended by the Developer unilaterally, without any special notice to the User.
4.2 The Developer has the right to provide information about the functioning of the Application, to display advertising, informational and other messages, through the Application and on the Client's mobile phone.

4.3 The Developer has the right to disable the User's access to the Application, if:

- If the use of the Application violates the norms of law, the provisions of this Agreement, or the rights of third parties;

- Unfair use of the Application;

- If the use of the Application is detrimental to the Developer or third parties;

4.4 The Developer has the right to process personal data that are used to improve the service.

5. CONDITIONS OF PARTICIPATION 

5.1 Only individuals can participate in the program.

5.2 The participants of the Program are individuals who downloaded the application and registered there, with obligatory indication of the Ukrainian GSM-operator's cell phone number and full name.

5.3 In case of loss or changing of the phone number, wrong indication of the date of birth and other questions, write to the e-mail: oper.marketolog.pizzahouse.com.ua.

5.4 The duration of the Participant status is unlimited and covers the entire duration of the Program.

6. ACTION OF BONUSES IN MOBILE APPLICATION

6.1 With each order the User receives bonuses.

6.2 Bonuses can be withdrawn only for products that are not in promotion.

6.3 Bonuses cannot be withdrawn for alcohol and sushi sets.

6.4 In 1 receipt it is possible only to charge or ещ withdraw the bonuses. The combination of withdrawing and earning bonuses at the same time is impossible.

6.5 It is not allowed to combine withdrawing of bonuses and a get discount for pick-up in one receipt. The user can choose to withdraw the bonuses or to use the 22% pick-up discount.

6.6 For delivery the bonuses can be withdrawn on condition of the minimum order amount of 300 UAH, which are not withdrawn. 

6.7 The bonuses are charged by the formula 1 bonus = 1 UAH.

6.8 The validity period of bonuses is 45 days from the moment of their adding. After bonuses expire, they are automatically removed from User's account.

7. FINAL STATEMENTS

7.1 Location of service provision - Kyiv, Ukraine. If there are any disputes or discrepancies related to performance of this Agreement, the User and the Developer will make all efforts to resolve them through negotiations between them. 

7.2 If any disputes, disagreements or claims arising out of or in connection with this Agreement cannot be resolved by negotiations, then these disputes shall be considered by a court in accordance with the laws of Ukraine at the location of the Developer.

7.3 Neither of the Parties to the Agreement shall be liable for non-performance or improper performance of obligations under this Agreement if proper performance was impossible due to force major. 

7.4 This Agreement is available in Ukrainian, Russian and English languages. 

7.5 If any statement of this Agreement is declared invalid, it does not affect the validity or applicability of the other provisions of this Agreement.
